Hello and welcome to the WorkPro blog. Today, we’re taking a look at what Australia’s revised Work Health and Safety Act requires when it comes to independent contractors.

Traditionally, this classification of workers has created some confusion over responsibility. Many people think when you outsource jobs to an independent contractor, you also outsource your workplace health and safety obligations.

That, however, is a misconception.

The revised legislation attempts to make responsibilities a lot clearer and easier to understand.

What’s the major takeaway? Independent contractors share health and safety obligations with the company that hires them.

They’re both considered a Person Conducting a Business or Undertaking in the legislation. That means they need to collaborate to comply with the law.
